MBTA Fair Evasion Public Hearing – Apr 15

In January 2021, Governor Baker signed a law decriminalizing fare evasion on the T. Violators will instead be issued a non-criminal citation with a fine proportionate to the nature of the offense. The law also gave the MBTA the regulatory authority to set fine levels.

With this new authority, the MBTA is proposing a new regulation to decrease fine levels. Riders can review and provide feedback on our proposed regulations before they are finalized.

Pursuant to Massachusetts General Laws, Chapter 40A s.9 & s.15, the Maynard Zoning Board of Appeals will hold a REMOTE public hearing on Monday, April 26, 2021 at 7:00 p.m. to hear all persons interested in the Variance Application filed by Stephanie L. Malone, 19 Lincoln Street, Maynard, MA.

The subject property, 19 Lincoln Street, is located within the Single-Family Residence Zoning District 1. The petitioner is requesting a Variance from Section 4.1.2 of the Zoning By-laws to: allow a change of a non-conforming structure on a non-conforming lot that will increase the existing nonconformities and allow construction of a front patio that will encroach into the required 25-foot front setback and increase the non-conforming lot coverage.

Pursuant to Massachusetts General Laws, Chapter 40A s.5, the Maynard Planning Board will hold a REMOTE public hearing on Tuesday, April 27, 2021 at 7:00 p.m. to consider the application filed by Derrick Maxwell on behalf of the owner and petitioner 31 Main Condominiums Trust, 31 Main Street, Maynard, MA 01754.

The Petitioner is requesting an amendment to the 31 Main Street Special Permit and Site Plan Review Decision dated February 26, 2019 to remove the requirement for three offsite parking spaces per Section VII of the Decision required by Section 9.4.9.2 of the Zoning By-laws.

Solar Array Project Meetings

There will be no joint meeting tomorrow evening between the Maynard Select Board and the Maynard School Committee regarding the proposed solar array facilities, intended to be scheduled for March 31, 2021.

However, the Maynard Select Board is expected to consider the topic at a future public meeting, tentatively within the first half of April 2021. Please check the town’s website for postings of public meeting notices.

Legal Notice: Planning Board Hearing – Apr 27th

Pursuant to Massachusetts General Laws, Chapter 40A s.5 and s.9, the Maynard Planning Board will hold a REMOTE public hearing on Tuesday, April 27, 2021 at 7:00 p.m. to consider the application filed by the owner and petitioner Maynard Crossings JV, LLC – Capital Group Properties, 259 Turnpike Road, Southborough, MA 01772.

The Petitioner is requesting to amend Section 3 of “Exhibit B” (Operations and Maintenance Plan) of the Special Permit Decision dated September 19, 2017 for the Maynard Crossings (129 Parker Street) mixed-use development. Exhibit “B” of the Decision includes internal management protocol and regulations within the project. The request proposes amending the Operations and Maintenance Plan (originally approved pre-construction by the Planning Board) to better coincide with project’s actual activities/scheduling as evaluated post- construction. The requested amendments include adjustments to the hours of operations, site lighting hours, and delivery hours for each different type of use throughout the project.

The request does not affect, and will remain consistent with, the Town-approved Concept Plan for the Project. This request is pursuant to Sections 9.3 and 10.4 of the Zoning By-laws and the Concept Plan approved by Town Meeting on October 5, 2016.

Legal Notice: Conscom Public Hearing – Mar 9th

The Maynard Conservation Commission will hold a remote public hearing on Tuesday, March 09, 2021 at 6:30PM via Zoom, relative to the filing of a Notice of Intent under the MA Wetlands Protection Act and the Maynard Wetlands Administration Bylaw, filed by Stonebridge Narrows Condominium Association, 10 Mill Street, Maynard MA 01754. The proposed project includes the removal of multiple trees located within Bordering Vegetated Wetlands and their respective 100-foot Buffer Area, River Bank, the 200 foot Riverfront Area, and within 100-Year Floodplain at 10 Mill Street.

Legal Notice: ZBA Hearing: 16 Waltham St

Pursuant to Massachusetts General Laws, Chapter 40A s.9 & s.15, the Maynard Zoning Board of Appeals will hold a REMOTE public hearing on Monday, February 22, 2021 at 7:00 p.m. to hear all persons interested in the Petition filed by Christine Tree Legal, 515 Main Street, on behalf of John Morreale, Sr., owner of the subject property located at 16 Waltham Street, Maynard, MA. 

The Petitioner is appealing the Building Commissioner’s Zoning Decision that use of the subject property for more than one dwelling unit is a “Non-Compliant” use which is neither protected as a Pre-Existing Nonconforming Use pursuant to M.G.L. c. 40A Sec.6, nor a use authorized by building permit and begun more than six years ago pursuant to M.G.L. c.40A Sec. 7.  The Petitioner contends on both counts that the current mixed use of the premises for four dwelling units and one office unit is permitted.
